These Terms and Conditions ("Agreement") govern the sale, installation, and use of vehicle tracking devices ("Trackers") provided by CAI-Smart Vision ("we", "our", or "the Company") to the customer ("Customer", "you", "your"). By purchasing and/or installing a Tracker from us, you agree to be bound by these Terms and Conditions.

1. Definitions

- Tracker: Refers to the vehicle tracking device sold and installed by the Company.

- Services: Includes the sale, installation, and maintenance of Trackers.

- Vehicle: The vehicle in which the Tracker is installed.

2. Sale of Trackers

2.1 Purchase and Payment:

By purchasing a Tracker, you agree to pay the agreed-upon price, including taxes, shipping, and other associated fees. Payment must be made in full prior to installation, unless otherwise agreed.

2.2 Product Availability:

We make reasonable efforts to ensure that products are available and accurate in terms of specifications. However, we reserve the right to modify, discontinue, or substitute products as necessary.

2.3 Warranty:

Trackers are provided with a warranty of 2 years from the date of installation, covering defects in materials and workmanship. The warranty does not cover damage caused by misuse, accidental damage, or failure to adhere to product guidelines.

3. Installation Services

3.1 Scope of Installation:

The installation of the Tracker will be performed by the Company or an authorised technician. Installation is guaranteed to meet industry standards and will be conducted at the Customer's location unless otherwise specified.

3.2 Customer’s Responsibility:

You must ensure the Vehicle is accessible and free from obstructions during the scheduled installation time. Any delays caused by the Customer may incur additional charges.

3.3 Installation Fees:

An installation fee is required, and any changes or additional work required beyond the original scope may be subject to extra charges, which will be agreed upon before proceeding.

4. Use of Trackers

4.1 Service Subscription:

To use the Tracker effectively, you may need to subscribe to a data service or connectivity plan, which is separate from the purchase price. You are responsible for selecting and maintaining this service, including the payment of any applicable fees.

4.2 Data and Privacy:

The Tracker collects and transmits data, which may include vehicle location, speed, and other metrics. By using the Tracker, you consent to the collection and use of this data for the intended purpose of tracking and monitoring the Vehicle.

4.3 Limitations of Liability:

While we make efforts to ensure the accuracy of the Tracker’s data, the Company is not responsible for inaccuracies, errors, or delays in tracking information. The Tracker is a tool, and you acknowledge that external factors (e.g., GPS signal interference) may affect performance.

5. Customer Responsibilities

5.1 Proper Use:

You agree to use the Tracker solely for lawful purposes and in accordance with manufacturer instructions. Any misuse, including tampering or unauthorised modification, will void the warranty.

5.2 Safety and Security:

You are responsible for maintaining the security of your Vehicle and Tracker, including securing access credentials, passwords, and any necessary security features.

5.3 Notification of Malfunctions:

You agree to notify the Company immediately in case of malfunction, damage, or failure of the Tracker.

6. Cancellation and Refunds

6.1 Cancellation of Order:

You may cancel the order within 14 days after purchase for a full refund, provided the installation has not yet occurred. After installation, cancellations will not be accepted, and refund requests may only be considered based on warranty terms.

6.2 Refunds:

Refunds are issued in accordance with our refund policy and applicable laws. Refunds for services rendered (e.g., installation fees) are generally not available unless there was an error on our part.

7. Limitation of Liability

7.1 Company’s Liability:

The Company’s total liability for any claim arising under these Terms and Conditions shall be limited to the total amount paid by you for the Tracker and installation services, excluding any consequential, incidental, or special damages.

7.2 Force Majeure:

The Company will not be liable for delays or failure in performance due to circumstances beyond our reasonable control, including natural disasters, strikes, or technical malfunctions.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company from any and all claims, damages, liabilities, and costs arising from your use of the Tracker, including but not limited to the violation of third-party rights or local laws.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

10. Amendments

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on our website or communicated to you directly. By continuing to use the services after such changes, you agree to the updated Terms and Conditions.
